Please read these Terms of Service carefully before using ProfitPie. By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. About ProfitPie
ProfitPie (“we”, “us”, “our”) provides an AI-powered property investment analysis platform available at profitpie.app and my.profitpie.app (collectively, the “Service”). The Service is intended for use by Australian residents and in relation to Australian property.
2. Eligibility
You must be at least 18 years of age to use the Service. By using the Service, you represent that you are at least 18 years old and have the legal capacity to enter into these Terms.
3. Account Registration
Some features of the Service require you to create an account. When creating an account, you must provide accurate and complete information. You are responsible for:
- Maintaining the security of your account credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorised access to your account.
We reserve the right to suspend or terminate accounts that violate these Terms or that we believe have been compromised.
4. Subscriptions and Payment
Free tier
ProfitPie Lite is available at no charge. Free tier features may change at any time with reasonable notice.
Paid subscriptions
ProfitPie Pro is available on a monthly or annual subscription basis. Pricing is displayed on the Service and is in Australian dollars (AUD) inclusive of GST where applicable.
- Subscriptions automatically renew at the end of each billing period unless cancelled.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period. No refunds are provided for partial periods, except as required by Australian Consumer Law.
- We may change subscription pricing with at least 30 days' notice. Continued use after the notice period constitutes acceptance of the new pricing.
Refunds
If you are not satisfied with a paid subscription, contact us at hello@profitpie.app within 14 days of your initial purchase and we will consider a refund at our discretion. Your rights under the Australian Consumer Law are not affected.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorised access to the Service, other accounts, or our systems.
- Scrape, copy, or republish content or data from the Service without our written permission.
- Use the Service to distribute malware, spam, or any harmful content.
- Reverse engineer, decompile, or disassemble any part of the Service.
- Use automated tools to access the Service in a manner that places excessive load on our infrastructure.
- Misrepresent your identity or impersonate any person or entity.
6. Not Financial Advice
ProfitPie is an analytical modelling tool. It does not provide financial, tax, legal, or investment advice.
The calculations, projections, and outputs produced by the Service are estimates based on the information you provide and our understanding of current Australian tax and property law. They are provided for informational purposes only and do not constitute advice. Property investment carries significant risk.
You should not make investment decisions based solely on the output of this Service. Always consult a licensed financial adviser, registered tax agent, or qualified solicitor before making investment decisions. See our full Disclaimer.
7. Intellectual Property
All content, software, designs, trademarks, and intellectual property on the Service are owned by or licensed to ProfitPie. You are granted a limited, non-exclusive, non-transferable licence to use the Service for your personal or internal business purposes in accordance with these Terms.
You retain ownership of any data you upload or input into the Service. By using the Service, you grant us a limited licence to use your data solely to operate and improve the Service.
8. White-Label Reports
Pro subscribers may generate white-label reports with their own branding. You are responsible for ensuring that any reports you distribute comply with applicable laws, including the Corporations Act 2001 (Cth) and ASIC requirements relating to financial services. ProfitPie accepts no responsibility for reports distributed to third parties by our users.
9. Limitation of Liability
To the maximum extent permitted by law, ProfitPie and its officers, directors, employees, and agents are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.
Our total liability to you for any claim arising from these Terms or your use of the Service is limited to the amount you have paid us in the 12 months preceding the claim, or AUD $100, whichever is greater.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded under Australian Consumer Law.
10. Availability and Changes
We aim to keep the Service available at all times but cannot guarantee uninterrupted access. We may perform maintenance, introduce new features, modify or discontinue features, or update these Terms at any time.
For material changes to these Terms, we will provide at least 14 days' notice by email or by posting a notice on the Service. Your continued use after the notice period constitutes acceptance of the updated Terms.
11. Termination
You may cancel your account at any time by contacting us at hello@profitpie.app.
We may suspend or terminate your access to the Service immediately, without notice, if you breach these Terms, engage in fraudulent activity, or for any other reason at our reasonable discretion. Upon termination, your right to use the Service ceases immediately.
12. Governing Law
These Terms are governed by the laws of New South Wales, Australia. You agree to submit to the exclusive jurisdiction of the courts of New South Wales for any disputes arising from these Terms or your use of the Service, without prejudice to your rights under applicable consumer protection laws.
